
The All Progressives Congress in Osun State has said last Friday’s ruling by the Court of Appeal did not mean that the 2011 elections which produced Osun State members of the National Assembly and the state legislature are invalid.
The Director of Publicity, Research and Strategy of the APC, Mr. Kunle Oyatomi, said this in a statement he made available to our correspondent in Osogbo, on Saturday.
The Court of Appeal sitting in Akure, the Ondo State capital, had thrown out the appeal filed by the Independent National Electoral Commission against an injunction restraining Ambassador Rufus Akeju from conducting the last general election in the state.
The PDP, while interpreting the judgment, claimed that the elections, which the defunct Action Congress of Nigeria won by landslide, had been invalidated by the ruling.
The Chairman of the PDP in the state, Alhaji Gani Olaoluwa, said in a statement on Sunday that the executive should implement the judgment.
He said, “The Court of Appeal had dismissed the appeal filed by INEC on a judgment that prevented Osun Resident Electoral Commissioner from conducting the 2011 elections in the state.
“The INEC committed a grave error by not obeying the judgement delivered by the Federal High court in February 2011.
“The implication of the Appeal Court judgment is that all senators, members of the House of Representatives and House of Assembly members from Osun State should desist from seeing themselves as lawmakers because the election which culminated in their representation had been declared null and void.”
But the APC said the ruling had no negative implication on the election of the lawmakers.
Oyatomi challenged the PDP to produce a certified true copy of the appellate court which the opposition party claimed stated categorically that the elections of federal and state legislators conducted by Akeju in 2011 had been nullified.
“Our authentic information is that the court declared that the process of filing the appeal by INEC was defective hence incompetent and was as a result struck out. The Court of Appeal neither made pronouncement on the substantive suit which is not before the Court of Appeal, but still pending in Osogbo, nor did it declare the elections of 2011 ‘null and void’ (as the PDP is misleading Nigerians),” APC said.
